NYLJ: New York GOP Files Federal Suit Challenging Constitutionality of 'Even-Year'Election Law

A Republican-led federal lawsuit filed Oct. 30 in the Eastern District of New York challenges New York’s Even Year Election Law, which shifts most municipal elections to coincide with statewide and federal contests. Brewer, Attorneys & Counselors filed the complaint against Gov. Kathy Hochul and the state on behalf of the New York Republican State Committee and localities on Long Island and in Orange County, following a 7–0 Court of Appeals ruling on Oct. 16 upholding the statute. Plaintiffs allege the law imposes severe burdens on candidates’ core political speech in violation of the First Amendment and violates the Voting Rights Act by exacerbating racially polarized voting; the measure excludes certain judicial offices and New York City, with local election timing changes beginning in 2026.
