City Land: State’s Even Year Voting Law Challenged in Federal Court

November 10 — On October 31, the New York GOP; Nassau, Suffolk, and Orange Counties; several towns; and local officials filed suit in the U.S. District Court for the Eastern District of New York challenging New York’s Even Year Elections Law (EYEL). The complaint alleges violations of the First and Fourteenth Amendments and Section 2 of the Voting Rights Act, claiming consolidation burdens political speech, dilutes certain voters’ influence, and permits national contests to overshadow local races. Plaintiffs seek to enjoin the law or allow local opt-outs, following an October 2025 New York Court of Appeals decision upholding EYEL and as voters in New York City rejected a related ballot measure while Suffolk County approved a delay.
